For most types of family law actions, a party needs to pay a fee to the clerk of the court when he or she files a petition. Current filing fees for the Thirteenth Judicial Circuit (Hillsborough County) for common family law matters are as follows:
- Adoption- $442.00*
- Child Support (non-divorce)- $300.00**
- Child Custody (non-divorce)- $300.00**
- Divorce- $408.00**
- Name Change- $414.00*
- Paternity- $300.00**
- Temporary Custody by Extended Family Member- $400.00*
In many cases, the person responding to the petitioner (a.k.a., the “respondent”) will want to file a response that includes a request for relief (such as child support or alimony). In these cases, the respondent will file a counterpetition and–in Hillsborough County–pay the following filing fees:
- For cases with *- $395.00
- For cases with **- $295.00
Additionally, once a final judgment has been entered, in many cases you may apply to have the judgment modified (such as child custody schedules or child support orders). Hillsborough County charges a $50.00 filing fee to reopen the matter and submit a supplemental petition to modify the final judgment.
Keep in mind that filing fees may differ from circuit to circuit and county to county. Also, as many courts are facing major budget deficits, I would not be surprised if filing fees are increased in the near future.
